Terms of Service for PropMotion

1. Introduction
Welcome to PropMotion. These Terms of Service (“Terms”) govern your use of the PropMotion web application and related services (“Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
The Service is provided by PropMotion (“we,” “us,” or “our”).
2. Description of Service
PropMotion is a web-based platform that uses AI to transform property photos into promotional videos. Users upload property images, optionally provide creative direction, and receive a finished video suitable for social media platforms including Instagram Reels, TikTok, and YouTube Shorts.
3. Eligibility
You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal authority to enter into these Terms.
4. Account Responsibilities
You are responsible for:
- Maintaining the security of your account credentials
- All activities that occur under your account
- Ensuring you have the legal right to upload and use the photos you submit
- Providing accurate and complete information during registration
- Notifying us immediately of any unauthorized use of your account
5. Acceptable Use
You may not use the Service to:
- Upload content you do not have the right to use
- Upload illegal, harmful, or offensive content
- Attempt to gain unauthorized access to our systems
- Use automated tools to scrape or abuse the Service
- Violate any applicable law or regulation
- Represent generated videos as professionally produced without disclosure
6. Intellectual Property
Your Content: You retain all rights to the photos and other content you upload. By uploading content, you grant us a limited license to process, store, and generate videos from your content solely for the purpose of providing the Service.
Generated Videos: Videos generated by PropMotion are licensed to you for your use in marketing and promoting your real estate listings. You may use these videos on social media, listing websites, and other marketing channels. You may not resell, redistribute, or claim authorship of the underlying AI-generated content.
PropMotion IP: The PropMotion platform, including its technology, software, design, and branding, is owned by PropMotion and protected by intellectual property laws.
7. Subscriptions and Payments
PropMotion offers free and paid subscription tiers:
- Free Tier: Limited number of videos per month, watermarked output
- Paid Plans: Higher or unlimited video generation, no watermarks, priority processing
Paid subscriptions are processed through Stripe. All fees are non-refundable except as required by applicable law or as otherwise stated in our refund policy.
Subscriptions automatically renew unless cancelled before the renewal date. You can manage or cancel your subscription at any time from your account settings.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily suspended for maintenance, updates, or due to circumstances beyond our control. We will make reasonable efforts to notify users of planned maintenance.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- Generated videos will meet your specific expectations
- The Service will meet all your requirements
- Any errors in the Service will be corrected
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROPOTION, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:
- Loss of data or content
- Loss of profits or revenue
- Loss of use or goodwill
- Any other intangible losses
Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless PropMotion and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.
12. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting us or using the account settings.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PropMotion operates, without regard to its conflict of law provisions.
14. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. If we make material changes, we will provide notice through the Service or by updating the “Last updated” date at the top of these Terms.
Your continued use of the Service after any changes constitutes acceptance of the new Terms.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
